(Daily Mail) A man accused of murdering his wealthy grandfather so he can collect his inheritance says that the real killer could be a 25-year-old woman who spent a weekend with the 87-year-old days before his death.
Attorneys representing Nathan Carman want to interview ‘Mistress Y’ about the time she spent with John Chakalos at Mohegan Sun casino in Connecticut.
Chakalos is also said to have given her $3,500 for breast enhancement surgery, according to the Hartford Courant.
On the night Chakalos was killed, he and the woman spoke for about 19 minutes on the phone, according to court documents filed in Rhode Island.
Chakalos, a multimillionaire property developer, was fatally shot in his Windsor, Connecticut home on December 20, 2013.
Family members allege that his grandson, Carman, shot Chakalos several times in the back of his head at close range.
Carman has never been charged. Police view him as a suspect.
Police sought an arrest warrant charging Carman with murder, but the court rejected this, citing a lack of evidence.
Carman is alleged to own a Sig Sauer rifle that his aunts say was used to kill Chakalos. The weapon has yet to be recovered.
He has been accused of killing Chakalos by his three aunts, who are in a bitter court battle over the multi-millionaire property developer's estate.
His aunts filed a 'slayer action' against him, a legal instrument designed to ensure someone who kills cannot profit from their victim's estate.
But Carman, who has maintained his innocence throughout the bitter feud, says the generous financial support he had been receiving provided him with no reason to murder Chakalos.
Carman’s aunts - Valerie Santilli, Elaine Chakalos, and Charlene Gallagher - have also accused Carman of killing his mother by deliberately sinking his boat during a fishing trip off the coast of Long Island in September 2016.
Linda Carman has been presumed dead since the boat sank. Her son was rescued eight days after the boat sank.
He was found floating in a raft off the coast of Martha’s Vineyard.
The aunts want a judge in New Hampshire to rule that Nathan Carman killed both his mother and grandfather.
They want the judge to deny him an inheritance worth millions of dollars from Chakalos’ estate.
Carman’s lawyers are now putting forward an alternate theory about Chakalos’ death.
They are seeking an interview with ‘Mistress Y,’ who hasn’t been named.
The woman in question allegedly met Chakalos while she worked for a property management company that tended to an apartment complex owned by Chakalos in Keene, New Hampshire.
Carman’s lawyers are alleging that Chakalos gave the woman as much as $800 each time they met.
Dan Small, a Boston-based lawyer representing the three aunts, slammed the latest filing by Carman’s attorneys.
‘Nathan’s shameful attack on his Grandfather today shows there is no depth to which he will not sink to avoid producing his gun, which is the probable murder weapon,’ Small said.
‘Now he is trying to cast blame on his own Aunt, even though she willingly took and passed a police lie detector test, while Nathan refused, and she cooperated fully and honestly with the police, while Nathan lied repeatedly, including about this very gun.
‘Every day that passes in these legal proceedings shows even more clearly that Nathan's behavior is calculated, evasive, and ultimately, guilty.’
A week before Chakalos’ murder, he spent the weekend with Mistress Y at Mohegan Sun in Connecticut, Carman’s lawyers allege.
After the murder, Connecticut police interviewed the woman. She told investigators that Chakalos gave her $3,500 for breast enhancement.
The woman denied that she had sex with him.
‘Mistress Y’ also told police that the day before he was killed, they had a 20-minute phone conversation that was ‘sexual in nature.’
She said they made plans to travel to New York City together over Christmas.
Carman claims that he left his grandfather’s house just as Chakalos started talking to his mistress.
He said his grandfather even paused the conversation with the woman to say goodbye.
Carman’s lawyers say that ‘Mistress Y’ was aware that Chakalos liked to keep stacks of $100 bills around the house.
The lawyers say that the woman could have planned Chakalos’ death.
She also could have told someone else in passing about the money lying around the house, according to the court filing.
‘Evidence from “Mistress Y’ dramatically alters our pre-conceived notion of what 87-year-old grandfathers do with their spare time,’ Carman’s lawyer, David Anderson, wrote in the court filing.
‘The fact of the matter is that living alone in a house in which he kept large amounts of cash placed John Chakalos at risk.
‘Mr. Chakalos’ lifestyle and activities prior to his death made him a target for a robbery and/or murder by some unknown person.’
Aside from ‘Mistress Y,’ Anderson also wants to depose Chakalos’ next door neighbor.
The neighbor told police she heard a loud bang at around 2am on the morning of December 20.
The neighbor said that an hour later, she heard tires from a car screeching as the vehicle drove away down the street.
This raises the possibility that Chakalos was killed at around that time.
Nathan Carman lived 7 days out at sea before being rescued in 2016
Investigators with Windsor police say that the murder took place sometime between 3 and 4am.
If Chakalos was killed at around 2am, this could exonerate Nathan Carman, who was seen on surveillance video at his apartment in nearby Bloomfield, Connecticut until 3am.
‘Simply stated if John Chakalos was shot at 2 a.m. then Nathan Carman clearly was not the murderer,’ Anderson wrote in the court filing.
Windsor police believe Nathan Carman is the main suspect in Chakalos’ murder.
Investigators said that Carman was the last person to see Chakalos alive.
They also allege that Carman removed the GPS system from his car as well as the hard drive from his computer the morning after the murder.
Carman has also refused to take a lie detector test.
Authorities also point to a missing Sig Sauer rifle that Carman bought weeks before his grandfather’s murder.
The lawyers for the three aunts say that forensic results show the caliber of the bullet used in Chakalos’ murder matches the gun.
Connecticut investigators sent bullet fragments to a forensic lab for testing.
Experts found that at least two of the bullet fragments came from a ‘.30 caliber class boat tail jacketed bullet,’ though they don’t specify which gun could have been used.
Sig Sauer rifles can fire either .308 caliber bullets or a 7.62mm cartridge.
The legal proceedings in Rhode Island initially started as an insurance dispute.
When Linda Carman was declared presumed dead after the fishing boat sank, the insurance company refused to pay an $80,000 policy.
The company argued in court that Nathan Carman caused the boat to sink.
Carman acknowledged in court that he removed trim tabs from the boat and filled the holes with an epoxy.
The insurance company says that the changes he made to the boat caused it to sink.
Nathan and Linda Carman set out for the Atlantic Ocean in September 2016.
They planned to go tuna fishing on a boat that was docked in a Rhode Island marina.
